9. Responsibility
9.1 In the event that the Warsaw Convention or the CMR applies, or any national laws that give effect to or make such conventions binding (hereinafter referred to as the Convention Rules for short), or if or to the extent that other mandatory national laws apply, UPS shall be liable definition, and its amount - a limitation in accordance with the specified applicable rules.

9.2 In the event that the Convention Rules or other mandatory national laws do not apply, UPS shall be liable only for acts done in the absence of reasonable care and due professionalism, solely in accordance with these Terms. To the extent permitted by applicable law, such liability of UPS shall be limited to proven damages and shall not exceed RUB 7,000 per shipment, unless a greater value of the shipment has been declared by the shipper in accordance with clause 9.4 below.

9.3 If a claim is brought by a person who, by his or her actions, caused or contributed to the loss of, damage to, or delay in delivery of, the shipment or item, or if it is brought by such person's successor in respect of said claim, UPS's liability for such claim , subject to the foregoing limitations, may be reduced or such liability may be excluded in accordance with the provisions of applicable tort laws.

9.4 Subject to clause 9.5, the shipper may receive a refund in excess of UPS's liability limit as set out in clause 9.2 above, the Convention Rules, or other mandatory national law. This is possible if the shipper indicated a higher value of the goods on the invoice and paid an additional fee for this in accordance with the Directory. If the shipper has declared a higher value for the shipment and paid a fee, UPS's liability is limited to proven damages up to and including the declared value of the shipment. The declared value of the consignment may not, in any case, exceed the limits set out in paragraph 3.1(ii).

9.5 Except as otherwise provided in the Convention Rules or other mandatory national laws, UPS shall not be liable for solely financial losses, such as the cost of alternative transportation, loss of profits, loss of business opportunity, or income forfeited due to non-use of the shipment caused by any loss , damage to the cargo or place of cargo, or delay in its delivery, regardless of whether the value of such cargo has been declared in accordance with clause 9.4.

UPS is not responsible for damage to or loss of any packaging.

10. Delivery
UPS will deliver the shipment to the consignee, or to another person that UPS determines is authorized to receive the shipment on behalf of the consignee (such as persons in the same building as the consignee). If such person is not available, the shipment may be left in the mailbox of the consignee (if applicable), delivered to neighbors, unless the shipper has excluded such a method of delivery by using the appropriate additional service.

The consignee must be informed of any alternative means of delivery (or forwarding to a UPS Access Point) by means of a notice left on the premises.

Notwithstanding the foregoing section, and unless otherwise agreed with the shipper, UPS may use any alternative delivery method chosen by the consignee in accordance with the terms of UPS My Choice® Service and any other agreement between UPS and the consignee. Such alternative delivery methods include, without limitation, redirecting the shipment to an alternative address (including a UPS Access Point), allowing the driver to leave the shipment at the consignee's premises, changing the type of service chosen by the shipper, or changing the delivery date. The shipper also agrees that the consignee may receive delivery information regarding the shipment. The shipper expressly waives any claims against UPS that may arise from UPS following any such instructions provided by the consignee.

UPS may use electronic devices to obtain confirmation of delivery, and the shipper agrees that no claim can be made against UPS solely on the basis that delivery of the shipment is confirmed by a printout of the consignee's signature obtained and stored electronically.
Except as otherwise provided in the Convention Rules or other mandatory national law, UPS shall not be liable under any circumstances for any suspension of carriage, redirection of delivery (to a different consignee or address other than that specified on the waybill), or return of the shipment. to the shipper and, in the event that UPS makes efforts but fails to do so, UPS shall not be liable for any resulting damages.

11. Information security
11.1 UPS may process personal data provided by a shipper or a consignee in connection with the carriage of UPS goods, transfer such data to other UPS group companies and UPS contractors, including in other countries that may have a different level of information protection from that in the country, where the shipper has transferred the shipment to UPS, and process it there, to the extent and to the extent that such transfer and processing in such countries is required to provide the agreed shipping services.

The shipper warrants that it (i) has obtained the personal data that the shipper has provided to UPS for transportation lawfully, (ii) is authorized to provide such data to UPS in the cases and to the extent that such transfer and processing of data in such countries required to provide the agreed delivery services, and (iii) has obtained the informed and express consent of such consignee that UPS may provide electronic and other notification to the consignee in connection with the agreed delivery services.

UPS uses shipper personal data provided by the shipper in accordance with the UPS Privacy Notice posted on the UPS website at http://www.ups.com/content/en/en/resources/ship/terms/privacy.html .

11.2 In addition, the shipper warrants that it has obtained the informed and express consent of the consignee that UPS may use the consignee's personal data in accordance with the above UPS Privacy Notice, as amended on the date the shipment was shipped, for use other than indicated above in subsection 11.1.

12. How to file a claim - Limitation period
Notice of all claims against UPS shall be made in writing and within a reasonable time, but in any case not later than 14 days from receipt of the shipment in the event of damage to the shipment (including partial loss) and, in the event of loss, within 60 days from the date the shipment was handed over to UPS for carriage, except as otherwise provided by the Convention Rules or other mandatory national law. In addition, all claims against UPS in connection with any Shipment shall be subject to a statute of limitations unless the proceeding is commenced and written notice of such proceeding is served on UPS within six months of receipt of the applicable Shipment or, in the case where the Shipment is not has been received, within six months of the date on which the shipment was due to be delivered. This provision does not affect the rights that the shipper may have under the Convention Rules or other mandatory norms of national law.

13. Full nature of the agreement and partial invalidity
UPS assumes that all terms and conditions of the contract between UPS and the shipper are contained in this document and in the Handbook. If the shipper wishes to change these terms in any way, such change must be in writing and signed by the shipper and a UPS representative before the shipment is accepted by UPS for carriage. The invalidity of individual provisions of these Terms does not entail the invalidity of other provisions.

14. Applicable law
These terms and conditions shall be governed by the law of the country in which the shipment was handed over to UPS for carriage.
