In Russia, the rules for the retail sale of alcoholic and alcohol-containing products are established by federal legislation. Moscow, the Moscow region and other regions have the right to adjust these norms towards tightening, for example, to reduce the time for selling alcohol.

We will tell you in more detail how long and how long alcohol is sold in Moscow and the Moscow region in 2019 and what threatens violators of the rules for the sale of wine, vodka and other "intoxicating" and low-alcohol drinks.

Federal control of alcohol turnover

The main document around which the entire regulatory and legal system is built to regulate the production and sale of alcohol is the Federal Law of 22.11.1995, No. 171-FZ "On state regulation of the production and turnover of ethyl alcohol, alcoholic and alcohol-containing products and on the restriction of consumption (drinking ) alcoholic beverages (as amended by Federal Law No. 18-ФЗ dated 07.01.1999) (as amended on December 27, 2018) (as amended from January 1, 2019) "

The law refers to alcoholic and alcohol-containing products the goods in which the concentration of ethyl alcohol is higher than 0.5% of the finished volume. Definition of concepts:

  • alcoholic: spirits (vodka, cognac, whiskey), wine, champagne, liqueurs, beer, cider, mead, etc .;
  • alcohol-containing: food (wine materials, wort) and non-food with the share of ethyl alcohol above 0.5% of the finished volume.

Retail sale of strong alcohol at points of the provision of catering services is carried out only by organizations. These are legal entities registered in Moscow and the region. Retail sale of beer, wine, champagne, cider in stores and in points of providing catering services is allowed to organizations and individual entrepreneurs.

For the free sale of alcohol, the distributor must obtain a license to carry out this type of activity. The buyer has the right to request the seller to provide a document with a barcode containing information about registration in the EGAIS.

It is illegal to sell alcohol to minors (clause 2 of article 16 of the Federal Law). The selling party has the right to require the young buyer to provide any document that determines the age: passport, driver's license, residence permit, diplomatic passport, temporary identity card, etc.

The law prohibits the sale of alcohol in buildings if they fulfill:

  • educational work (d / s and schools, municipal and private, vocational schools, etc.);
  • medical work;
  • cultural or sporting events;
  • in the territories adjacent to the listed buildings. The boundaries of the adjacent zone are marked on the spot by the regional authorities.

The sale of alcohol is prohibited:

  • in transport, at stops, in areas of air and railway passenger traffic, at gas stations and adjacent areas;
  • in places with a large number of people during mass events.

The question that is relevant in our time for sellers and buyers: from how many hours they sell alcohol in 2018 is spelled out in paragraph 9 of Article 16 of the Federal Law. Retail sales are limited from 11:00 pm to 8:00 am local time the next day.

Does not affect the prohibition of the Federal Law:

  • places providing catering services. The sale of alcoholic beverages takes place necessarily in unpacked containers or on tap;
  • on board ships and aircraft using the rights of the EAEU;
  • at points of duty-free sale of goods.

The prevailing opinion that in large shopping centers such as Auchan, Perekrestok, Bristol, Magnit, Lenta, etc., night sales of alcohol are allowed, is contrary to reality. All organizations involved in the circulation of alcoholic and alcohol-containing products are obliged to obey and comply with the law.

The Federal Law gives the regional legislature the right to impose reinforcing bans on the sale of alcoholic goods. To find out how long alcohol is sold in Moscow and the Moscow region and from how long alcohol is sold in Moscow (2019), you need to refer to local regional legislation.

Restrictions on the sale of alcohol in Moscow

The basic document governing the rules and timing of the sale of alcohol in Moscow in 2018 is the Decree of the Moscow Government dated December 28, 2005 No. 1069-PP on measures to comply with and control the legal acts of the Russian Federation in the field of alcohol circulation. The decree obliges law No. 171-FZ of 22.11.1995 to be adopted and enforced on the territory of Moscow, and on its basis the sale of alcohol in Moscow is regulated. Sale ban time in the capital: from 11 pm to 8 am next day.

The resolution not only regulates how much alcohol is sold in Moscow, but also limits the distance at which retail trade in alcoholic beverages is prohibited:

  • to kindergartens, schools, vocational schools - 100 m. Distance for points providing catering services - 25 m;
  • to sports facilities, medical facilities, places of entry / exit to the underground metro, railway stations, airport buildings and train stations - 25 m.

Information update: on the eve of the May holidays, the Moscow authorities decided to limit the sale of alcohol in Moscow from April 29 to May 2, as well as on May 9 in crowded places - at festive events, in parks, squares and pedestrian streets.

Restrictions on the sale of alcohol in the Moscow region

To the workers regulatory document that regulates the retail sale of alcohol in the Moscow region is the law of MO No. 40/2012-OZ dated 04/27/2012, as amended on 12/21/2017.

IN previous version of the law, article 6 introduced an additional veto on the sale of alcohol from 9 pm to 11 am the next day local time.

In December 2017, Article 6 was abolished and the time for the sale of alcohol in the Moscow Region was fixed at the federal level. The sale of alcohol in the Moscow region is limited to night and morning hours, as is the sale of alcohol in Moscow. The time in 2018 prohibiting the retail sale of "strong" and low-alcohol drinks in the region was established from 11 pm to 8 am the next morning.

Responsibility for violations

Ignoring the norms for the sale of alcoholic and alcohol-containing products (if it does not entail a criminal act) falls under the administrative responsibility of Article 14.16 of the Administrative Code of the Russian Federation No. 195-FZ dated 30.12.2001. These norms

For the distribution of alcohol at points of sale at night (applies to all regions, including Moscow and the Moscow region), a fine:

  • officials - 20,000 - 40,000 rubles. plus complete withdrawal of alcoholic beverages;
  • legal entities - 100,000 - 300,000 rubles. plus a complete withdrawal of alcoholic beverages.

Selling alcohol to minors imposes a fine:

  • officials - 100,000 - 200,000 rubles;
  • legal entities - 300,000 - 500,000 rubles.

Alcoholic sale without permissive documents:

  • officials - 10,000 - 15,000 rubles. plus complete withdrawal of alcoholic beverages;
  • legal entities - 200,000 - 300,000 rubles. plus the complete withdrawal of alcoholic beverages.

Should you shorten your sales time?

Almost every year, the question of toughening the requirements for the sale of alcohol in Moscow is raised. They want to shorten the time with the expectation of reducing the consumption of alcoholic products by the population. The Ministry of Health of the Russian Federation has repeatedly made more radical proposals, in particular, to completely ban the sale of alcohol on weekends.

However, the experiment, which took place in the Moscow region, where the time for selling alcohol was reduced, showed that the tightening of requirements on the volumes of consumption of vodka and beer does not greatly affect, but rather feeds the market for illegal sale of alcohol.

What do you think, from what time is it necessary to sell alcohol in the Moscow region and Moscow and until what time? Write your opinion in the comments.

Restrictions on the sale of alcoholic beverages will be introduced in Moscow during the May holidays.

Thus, on May 1, 8 and 9, even weak alcohol cannot be purchased in places of public events and nearby retail outlets.

Ordinary soft drinks in glass containers will also be banned. These measures have been taken to ensure safety in Moscow and to prevent injuries among the townspeople.

Russian regions, one after another, are introducing a ban on the sale of alcohol on Victory Day. This decision has already been made by the authorities in 24 constituent entities of the Russian Federation. Their number may still increase. Experts note that for shops and alcoholic beverage producers, the restriction of sales will not bring losses, which are noticeable in the results of the month.

In a number of Russian regions, the sale of alcohol on May 9 will be limited. The decision to ban sales in places of celebration has already been taken by the authorities of Moscow, Crimea, Belgorod Region, and the Republic of Khakassia. In these regions, restriction orders are adopted every year. The permanent ban on the sale of alcohol on May 9 has been enshrined in the legislation of the Perm Territory, Tambov and Tyumen regions for several years. The authorities of Karelia also reported about the possibility of introducing a ban.

In a number of regions and cities, officials are acting softer - they do not impose a direct ban, but send entrepreneurs a recommendation not to sell alcohol on Victory Day. So this year did, for example, in the administration of Barnaul.

At the same time, the legislation of a number of subjects already restricts the sale of alcohol "in the places where the holidays are held" - this is the order in Mordovia, Omsk, Orenburg regions, Sevastopol.

Vadim Drobiz, general director of the Center for Research on Federal and Regional Alcohol Markets (TsIFRRA), claims that even if a ban on alcohol sales on Victory Day is introduced in all regions, this will not affect the revenue of stores and alcohol producers.

One trading day, of course, will be unprofitable, but this will not be noticeable even by the results of the month. A difference of only hundredths of a percent is possible, the expert said.

Vadim Drobiz also suggested that many Russians would simply prefer to buy alcohol on the eve of the holiday.

President of the National Trade Association Vadim Zuikov also said that the one-day ban on the sale of alcohol does not "hit" the revenue of stores, but noted that this brings inconvenience to entrepreneurs.

Not all stores have a separate rack for alcohol, and a technical problem arises of how to fence off the bottles. We have to involve additional employees for rearrangements in the hall or explanations to buyers, - explained Vadim Zuikov.

As already reported by Izvestia, in last years The Ministry of Health records a decline in Russians' interest in alcohol. According to preliminary data from the ministry, last year the rate of alcohol consumption in terms of absolute alcohol per capita per year decreased by 0.2 liters in relation to 2015 and amounted to 10.3 liters. Liquor sales fell 2.4%.

May holidays in Moscow want to make more "dry" - the sale of alcohol in the capital will be limited from April 29 to May 2, as well as on Victory Day, May 9. The website of the mayor of Moscow informs that alcohol cannot be bought in stores located near places of mass festivities - pedestrian streets, parks and squares.

"Prohibition" will also restrict the sale of beer and any soft drinks (water, juices) in glass bottles and other fragile containers.

According to the head of the department of regional security and anti-corruption of the city of Moscow, Vladimir Chernikov, limiting the sale of alcohol on holidays is necessary to "prevent injuries among vacationers" and to prevent offenses. NSN... Note that similar restrictions are imposed on all major city holidays.

To ensure that this point and many others are not violated, there will be reinforced police squads. Another 25 April Moscow Russia reported that law enforcement officers will suppress any violations of public order for the May holidays in the capital, reports FAN .

“Moscow will host a large number of events and festivities dedicated to the celebration of the Spring and Labor Day. Employees of the capital's police, together with representatives of the National Guard and the people's squads, will ensure the protection of public order and the safety of citizens, ”the statement says.

The press service of the metropolitan police also recalled that

all participants in uncoordinated public events will be photographed and filmed for further legal assessment of their actions.

It is emphasized that if violations are found, they will be held accountable.

Non-working days on May holidays will be April 29 and 30, as well as May 1, 2 and 9. More than 300 major events and concerts will take place in Moscow in the first week of the last month of spring. On May 1, a trade union demonstration will take place on Red Square.

On Victory Day, the main events will be the parade military equipment on Red Square and evening fireworks - it can be watched from 33 sites. Artillery installations will give tens of thousands of salute salutes in just 5 minutes - the fireworks are scheduled to start at 22:00.

In order for Muscovites to enjoy good weather on May Day, the clouds will be dispersed using a Yak-42D laboratory aircraft. The authorities will carry out the same operation on Victory Day. The aircraft will perform research flights to improve weather conditions in the city. It will be joined by nine aircraft of the military space forces. The squadron will clear the sky using pyro cartridges with silver iodide, powdered reagent, liquid nitrogen, and granular carbon dioxide.

In 2018, dispersal of clouds in the capital on May 1 and 9, June 12 and on City Day will cost the authorities a total of 400 million rubles. In total, 12 units of special aviation will be involved in the operation.

Ground public transport on holidays, April 30, as well as May 1 and 2, will work according to the weekend schedule, said Deputy Mayor of Moscow Maxim.

He said that from 12:00 to 19:00 on these days the maximum number of buses, trolleybuses and trams will be launched. According to him, on May 9, routes will be strengthened, suitable for the Victory Park on Poklonnaya Gora, 42 buses of large and extra-large class will be allocated.

Liksutov added that during the rehearsals and the Victory Parade itself on Red Square (April 26, May 3, 6 and 9), it is planned to change the movement of 55 routes of urban land transport. Data on changes in the work of transport will be posted on the official resources of the mayor's office.

The Moscow metro and the MCC will operate on the May holidays as usual.
